Sports and Events Booking Policy
The following terms and conditions apply to all occasional use or ad hoc Sports and Events Services provided by SES to Customer. Capitalized terms shall have their meaning as set forth in the SES Sports and Events Agreement or Sports and Events General Terms and Conditions. In case of any conflict between the terms of this Booking Policy and the General Terms and Conditions, the terms of this Booking Policy will control.
- BOOKING POLICY
- Minimum booking per service is fifteen minutes, with increments of five minutes. Charges will be pro-rated from the hourly rate
- On US domestic capacity and non-SES in-house capacity, increments of fifteen minutes shall apply.
- SES reserves the right to substitute frequencies and/or satellite with substantially equivalent capacity serving Customer’s required coverage area, and/or to substitute teleport facilities, upon notice to Customer as soon as reasonably possible prior to commencement of Service.
- All space segments are on a first come first serve basis and subject to availability and therefore may not be available when Customer places an order.
- Requests for Service will not be accepted if they fall beyond the relevant rolling period for the capacity or beyond the termination date of the Sports and Events Agreement, whichever is earlier.
- Unless otherwise specified in the Order Confirmation, any and all occasional use or ad hoc Services are made available on a preemptible basis and may be deliberately pre-empted or interrupted by SES at its sole discretion.
- Please note that if you are providing any services into, out of, or otherwise for the benefit of or use by entities/persons in OFAC sanctioned countries (i.e. Cuba; Iran; North Korea; Russia; Syria; and the Crimea, Donetsk, and Luhansk regions of Ukraine), you must notify SES at the time of your booking request. Note that there may be a delay in service while SES confirms regulatory compliance for such services.
CANCELLATION POLICY
Standard SES Services
(Including SES satellite capacity, turnaround, fibre, and Internet delivery)
- Cancellation up to 7 days prior to the start of the event: no cancellation charge
- Cancellation from 7 days up to 48 hours prior to the start of the event: 25% cancellation charge
- Cancellation within 48 hours of the start of the event: 100% cancellation charge
Bookings Including Third-Party (Out-of-House) Capacity
- Where Services include satellite capacity or other services provided by third-party vendors, cancellation charges will be applied in accordance with the applicable third-party vendor’s cancellation policy.
- In such cases, the third-party cancellation terms will apply to the entire booking, including associated SES services.
- If a Service is sold as a bundle that includes both SES assets and third-party assets, the strictest applicable third-party cancellation policy will apply to the full bundle.
Feeds Booked on a “Challenge” Basis
- Any feed booked on a challenge basis will incur a 100% cancellation charge, regardless of the timing of the cancellation.
Partial Cancellations / Reductions
- Services that are shortened or reduced from their original firm booked time will incur cancellation charges only for the reduced portion, calculated in line with the timelines above (or the applicable third-party policy).
Approx Out Policy
- Where an Approx Out is entered, the Customer will be billed for the full booked duration.
- An Approx Out allowance of 15 minutes per booked hour, up to a maximum of 60 minutes, is permitted.
- LINE UP AND TESTING POLICY
- Customer will receive ten minutes of line-up free of charge prior to start of service.
- Any request for free of charge testing beyond the line-up must be approved in writing by SES.
- SES reserves the right to cancel line-up periods, at its sole discretion.
- For transportable uplinks, once coordination and successful testing are complete, the antenna and subsystems must not be changed in any way or the access coordination must be repeated.
- INQUIRY/ 'PENCIL' BOOKING
- SES offers ‘pencil bookings’ (tentative bookings, subject to confirmation or challenge) to customers on most connectivities for within the booking window, excluding day-of-air.
- All pencil bookings must be made through the SES booking system.
- Pencil bookings which are not confirmed by the Customer may expire, without notice, twenty-four hours prior to the inquired booking.
- In the event a pencil booking is challenged by another customer’s firm request, SES will notify the Customer (including weekends and overnights). If Customer does not notify SES within twenty-four hours of the challenge that Customer wishes to make the booking firm, the pencil booking will be automatically dropped from the system.
- In the event that a challenge is won by the Customer, the Customer’s firm booking carries a 100% cancellation charge for cancellation at any time.
- SES is not obligated to communicate with Customers regarding the status of inquiries.
- PAYMENT TERMS
- Invoices will be issued by SES in the month following the month during which Service was provided, with payment due within thirty days of invoice.
- SES will charge Customer for the higher between the confirmed booking time and the actual use time by Customer. For removal of doubt this provision does not permit Customer to continue using the Service beyond the time period designated in the Order Confirmation.
- SES reserves the right not to confirm an order in the event Customer has outstanding payments due for prior Services.
- Customer agrees that services may be invoiced by New Skies Satellites B.V. or another member of the SES group of companies, including without limitation MX1 Ltd., depending on the services provided, but in any case such services will be subject to the SES Sports and Events Agreement signed by Customer including this Booking Policy and the General Terms and Conditions.
- ADDITIONAL TERMS
- Orders for service are placed with the SES booking office or on-line prior to service.
- Service extensions are coordinated by the SES booking office or the access centers per the Order Confirmation.
- Transmitting earth stations must contact the SES access center prior to start of transmission and follow access center instructions. Transmit antennas are required to follow the SES Satellite Access Procedures or applicable third party procedures, a copy of which is available to customer upon request.
- In the event that Customer fails to follow the required procedures or Customer's antenna is refused access to the satellite for failure to meet required specifications, all charges for the Service will continue to apply.
